Why the ‘buy’ button on iTunes may cause legal trouble for Apple


According to a report by The Hollywood Reporter, a federal court in California has said that Apple must face a lawsuit over the ‘buy’ button. As per the report, David Andino, the lead plaintiff in the case has alleged that the ‘buy’ button on iTunes is deceptive.

The iTunes Store app on iPhone is a place where users can ‘buy’ or even ‘rent’ movies, music and ringtones. It looks like this may be the very reason why Apple is facing legal trouble. According to a report by The Hollywood Reporter, a federal court in California has said that Apple must face a lawsuit over the ‘buy’ button. As per the report, David Andino, the lead plaintiff in the case has alleged that the ‘buy’ button on iTunes is deceptive. He claims that the company can terminate access to the purchased content by a user on their own. In fact, he said that Apple has done that many times in the past. He further said that if he had known the content he purchased from iTunes would become unavailable one day then he wouldn’t have purchased it or at least paid as much as he did.
Apple wanted to get the case dismissed as it argued that “no reasonable consumer” would actually think or believe that the purchases from iTunes would remain there indefinitely. A judge in Sacramento, California has dismissed Apple’s attempt to get the case dismissed.. With Apple’s motions to dismiss ignored, the case is now open to an injunction, unless it gets settled beforehand.
The judge, John Mendez, had this to say against Apple’s argument “Apple contends that ‘[n]o reasonable consumer would believe’ that purchased content would remain on the iTunes platform indefinitely. But in common usage, the term ‘buy’ means to acquire possession over something. It seems plausible, at least at the motion to dismiss stage, that reasonable consumers would expect their access couldn’t be revoked.”
The case, according to the report, is now open to injunction and Apple may face legal hassle over it, unless the company and plaintiff reach a settlement.
