A tenant from BTM Layout claims that after vacating his apartment and fulfilling all contractual obligations, his landlord disappeared without returning the security deposit. The Incident: A Tenant’s Claim

According to a Reddit post shared on r/BangaloreRentals, the tenant, identified only as Chaitanya, vacated his rented flat in BTM Layout after providing proper notice and handing over the property in good condition. The rental agreement stipulated the return of the security deposit upon vacating the premises. However, post-vacancy, Chaitanya alleges that his landlord ceased all communication, ignoring calls, messages, and emails. The landlord’s sudden disappearance has left Chaitanya without his rightful deposit and without any explanation.

Chaitanya’s experience is not an isolated case. Many tenants in Bengaluru have reported similar issues where landlords fail to return security deposits after lease termination. A notable instance involved a tenant who rented a 3.5 BHK apartment for ₹55,000 per month during the COVID-19 pandemic. After vacating the property, the landlord attempted to deduct substantial amounts for alleged damages. The tenant, suspecting the landlord’s intentions, conducted thorough research and contacted the Ministry of Defence, the landlord’s former military unit, and a private golf club, alleging misuse of position. This led to the landlord returning the full deposit without any deductions.

Under the Karnataka Rent Act, 1999, tenants have the right to a refund of their security deposit upon vacating the property, provided they have adhered to the terms of the rental agreement. The Act stipulates that any deductions from the deposit must be justified and documented. In cases where landlords refuse to return the deposit, tenants can approach the Karnataka State Consumer Disputes Redressal Commission or the local police. However, the enforcement of these rights often faces challenges due to lack of awareness and procedural delays.
